DISTANCE SALES AGREEMENT

ARTICLE 1. PARTIES

ARTICLE 2. SUBJECT OF THE AGREEMENT
2.1. The subject of this Agreement is to regulate the rights and obligations of the Parties regarding the sale and delivery of products or services (hereinafter referred to as “Products”) ordered by the Buyer through the website www.guvenismetal.com.tr (hereinafter referred to as the “Website”) in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

2.2. The Buyer accepts and declares that they are informed about the characteristics of the Products, sales price, payment methods, and other details provided on the Website, and they have approved these electronically.

ARTICLE 3. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. Obligations of the Seller:

The Seller is responsible for delivering the ordered Products to the Buyer in accordance with the specifications stated in the order, without any defects, and within the delivery time specified on the Website.
The Seller ensures that the Products are delivered to the Buyer or the third party/address specified by the Buyer within the promised period. If the delivery becomes impossible, the Seller shall notify the Buyer and refund the payment within 10 (ten) business days.
3.2. Obligations of the Buyer:

The Buyer agrees to provide accurate and complete information when placing an order. The Buyer is solely responsible for any errors or omissions in the information provided.
The Buyer declares that they have read and understood all the preliminary information and approved the Agreement electronically.
The Buyer undertakes to inspect the Products at the time of delivery and notify the Seller immediately in case of any visible damage or defect.

ARTICLE 4. PRODUCT DELIVERY AND RETURN POLICY

4.1. Delivery of Products:

The delivery will be made to the address specified by the Buyer in the order.
The shipping cost will be covered by the Seller unless stated otherwise on the Website.
4.2. Return of Products:

The Buyer has the right to withdraw from the Agreement without providing any reason within 14 (fourteen) days from the delivery date, provided the Products are unused and in their original packaging.
To exercise the right of withdrawal, the Buyer must notify the Seller in writing or via email within the withdrawal period.
The return shipping cost will be covered by the Buyer unless the Product is defective or damaged.
4.3. Refund Process:

Upon receipt of the returned Products, the Seller will inspect them and refund the payment to the Buyer’s account within 10 (ten) business days, provided the Products are in resalable condition.
4.4. Exceptions to the Right of Withdrawal:

Products that are custom-made or personalized at the Buyer’s request are not subject to the right of withdrawal.
ARTICLE 5. GENERAL PROVISIONS

5.1. The Buyer agrees that they have read and understood the preliminary information and the terms of this Agreement on the Website before placing the order.

5.2. All disputes arising from this Agreement shall be resolved by the Consumer Arbitration Committee or the Consumer Courts in the jurisdiction of the Buyer’s or Seller’s location, as per applicable laws.

ARTICLE 6. EFFECTIVENESS OF THE AGREEMENT
This Agreement comes into effect once the Buyer approves it electronically and places an order on the Website.
